To all registered Professional Engineers,

It has come to the attention of the Board of Engineers Malaysia that many registered Professional Engineers are practising through non-registered Engineering Consultancy Practices (ECPs). The Board would like to remind them that by doing so, they would be contravening Section 7A(1) and Section 15(1)(m) of the Registration of Engineers Act 1967 which reads as follows :

Lembaga Jurutera Malaysia telah menerima banyak pertanyaan dari jurutera perunding berhubung penguatkuasaan Scale of Fees (Revised 1998) dalam melaksanakan projek-projek kerajaan di mana Jurutera Perunding sering menghadapi masalah dalam tuntutan bayaran perkhidmatan mereka. Salah satu isu adalah kos bagi kerja-kerja ‘Preliminaries’.

Lembaga Jurutera Malaysia ingin menjelaskan seperti berikut -

“Cost of Preliminaries and General Conditions are normally priced in the Bills of the Tender or Contract document. This cost is part of the cost to the client for the works and should be included in the overall cost of the works for the computation of the professional fees in accordance with clause 1(1) (b) in Part B of the Scale of Fees (Revised 1998).

However, where costs involved are contingency items, only their actual costs incurred should be included in the overall cost of the works.”

Dokumen Scale of Fees (Revised 1998) P.U.(B)548 yang telah diwartakan pada 31 Disember 1998 ini telah digunapakai oleh Kementerian Kewangan sejak 1 Jun 2005 bagi pengiraan kos perkhidmatan perunding bidang kejuruteraan melalui surat Kementerian Kewangan bilangan S(K&B)(8.09)735/9-24 Jld 8 (4) bertarikh 19 Mei 2005.

Lembaga Jurutera Malaysia meminta semua pihak termasuk Kementerian, Jabatan Persekutuan, Kerajaan Negeri, Badan Berkanun Persekutuan, Pihak Berkuasa Tempatan dan Syarikat Kerajaan menggunapakai Scale of Fees (Revised 1998) bagi pengiraan kos perkhidmatan jurutera perunding dalam melaksanakan projek-projek kerajaan.

The Board of Engineers Malaysia would like to inform that the Customs Appeal Tribunal (TRK) was established pursuant to amendments made to the Customs Act 1967 [Act 235], the Excise Act 1976 [Act 176], the Sales Tax Act 1972 [Act 64] and the Service Tax Act 1975 [Act 151] with effect from 1 June 2007.

Any practicing engineer who is not satisfied with the decision of the Director General of Customs on issues that are mainly related to the classification and valuation of goods and taxable services (except for cases relating to compound & subsection 128(3) Customs Act 1967), may appeal against the decision of the Director General of Customs.

The Board has reviewed its decision on competency examination as follows:

Graduate Engineers applying for the PAE with effect from 1st June 2008 will be required to sit for competency examination.

The above statement supersedes the previous statement which was publised in The Ingenieur (volume 39, Sept-Nov 2008, paragraph 1 of page 20).
